Welcome to Switch Classroom. These Terms of Service (“Terms”) govern your access to and use of our website, located at www.switchclassroom.org, and all associated content, services, and applications (collectively, the “Service”). The Service is provided by Switch Energy Alliance, a Texas nonprofit corporation (“Switch Classroom,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, you must not use the Service.
1. Eligibility & Age Requirements
The Service is intended for educators and related professionals. If you are under the age of 18, you may only use the Service with the consent and supervision of a parent, legal guardian, or authorized school official.
- COPPA Compliance: We do not knowingly collect personal information from children under 13 in the U.S. without parental consent.
- International Users: If you are located outside the U.S., you must comply with your country’s local age of digital consent (e.g., 16 in some jurisdictions).
2. Use of the Service
You may use the Service solely for personal, non-commercial educational purposes in compliance with all applicable laws, rules, and regulations.
3. User Accounts
a. Account Creation: Certain features require an account. You agree to provide accurate and complete information.
b. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at classroom.support@switchon.org of any unauthorized access.
c. Termination by Us: We may suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms or applicable laws.
4. Intellectual Property Rights
a. Our Content: All original content, features, and functionality of the Service are owned by Switch Classroom or our licensors, protected by copyright, trademark, and other laws.
b. License for Educational Use: We grant you a limited, non-exclusive, non-transferable license to download, print, and distribute materials solely for classroom use and other non-commercial educational purposes. Account holders may be allowed to edit and adapt content for their own classroom use.
c. Prohibited Use of Content: You may not reproduce, distribute, modify, or create derivative works of our content for commercial purposes without our written consent.
5. Prohibited Conduct
You agree not to:
- Use the Service for unlawful purposes;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service;
- Transmit malware or harmful code;
- Use automated tools to scrape or collect data without permission;
- Harass, threaten, impersonate, or harm other users;
- Send unsolicited commercial messages (“spam”).

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWITCH CLASSROOM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless Switch Classroom from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute shall be resolved by binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
11. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect the most recent version. Continued use of the Service after changes means you accept the revised Terms.
